These Terms and Conditions ("Terms") govern your use of the website located at www.hickoryfenceanddeck.com and any services provided by Custom Hickory Fence & Deck ("Company," "we," "us," or "our"). By accessing our website or engaging our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.
By using our website or requesting services, you confirm that you are at least 18 years of age and have the legal authority to enter into agreements. If you are acting on behalf of a property owner or another party, you represent that you have the authority to bind that party to these Terms.
We reserve the right to update these Terms at any time. Changes take effect when posted to this page with a revised Effective Date. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms.
Custom Hickory Fence & Deck provides residential deck building, fence installation, and related outdoor construction services in Hickory, NC and surrounding communities. Services include but are not limited to custom deck design and construction, composite and wood deck installation, deck repair and replacement, fence installation, screened porches, pergolas, covered decks, and related outdoor structures.
Our website provides general information about these services. It does not constitute a binding service agreement. A formal written contract, signed by both parties, is required before any work begins.
All estimates are provided in writing following an on-site consultation and are valid for 30 days from the date issued unless otherwise noted. Estimates are based on the scope of work described at the time of the site visit. Changes to the scope of work after an estimate is issued may result in a revised estimate.
Estimates are not final contracts. Work begins only after a written contract has been signed by both the customer and a representative of Custom Hickory Fence & Deck. Verbal commitments, text messages, or email exchanges do not constitute a binding agreement unless incorporated into a signed written contract.
Prices may be affected by material cost changes, site conditions discovered after work begins, permit requirements, or scope changes requested by the customer. Any changes that affect the contract price will be documented in a written change order before additional work is performed.
Project start dates are scheduled after a signed contract and required deposit are received. Start dates are estimates and may be affected by permit processing times, material availability, weather conditions, or other factors outside our control. We will notify you promptly of any material changes to the project schedule.
If you need to cancel or reschedule, please contact us as soon as possible. Cancellation terms - including any applicable fees related to materials ordered or permit costs incurred - are set forth in the individual service contract. We reserve the right to reschedule work due to unsafe weather conditions, material delays, or other circumstances beyond our control.
Payment terms are established in the individual service contract. A deposit is typically required to secure your project start date and cover initial material costs. The remaining balance is generally due upon project completion unless otherwise agreed in writing.
Accepted payment methods are specified in your contract. Payments not received by their due date may result in a halt to work until the account is brought current. Accounts that remain past due may be subject to collection proceedings, and the customer may be responsible for reasonable collection costs including attorney fees, to the extent permitted by law.
We do not require full payment upfront before any work begins. Any contractor requesting full payment before work starts is a practice we do not follow.
Where required by local regulations, Custom Hickory Fence & Deck will obtain the necessary building permits for the work covered under your contract. Permit fees may be included in the project price or itemized separately, as stated in your contract. We schedule and manage required inspections as part of the permitting process.
You agree to provide access to your property as needed for permit-related inspections and to cooperate with any reasonable requests from local building officials.
You are responsible for providing accurate information about your property, including any known underground utilities, HOA requirements, easements, or restrictions that may affect the work. Failure to disclose known conditions that materially affect the project may result in additional costs that are the customer's responsibility.
You agree to keep the work area clear of people, children, and pets during active construction. We are not liable for injury or damage resulting from unauthorized access to the work zone.
Any workmanship warranty provided by Custom Hickory Fence & Deck is described in your individual service contract. Manufacturer warranties on materials (such as composite decking boards) are separate from our workmanship warranty and are subject to the terms of the applicable manufacturer.
Workmanship warranties do not cover damage caused by misuse, accidents, acts of nature, normal wear and tear, unauthorized modifications, or failure to perform recommended maintenance. Our website and any general information provided are offered "as is" without warranty of any kind, express or implied.
To the fullest extent permitted by applicable law, Custom Hickory Fence & Deck shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our website or our services, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising from or related to our services shall not exceed the total amount paid by you to us under the applicable service contract.
Nothing in these Terms limits our liability for fraud, gross negligence, or any other liability that cannot be excluded by law.
All content on this website - including text, images, logos, and design - is the property of Custom Hickory Fence & Deck or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission.
If a dispute arises between you and Custom Hickory Fence & Deck, we ask that you contact us first at sales@hickoryfenceanddeck.com so we have the opportunity to resolve the matter directly. Most issues can be resolved quickly through direct communication.
If a dispute cannot be resolved informally, both parties agree to attempt good-faith mediation before pursuing litigation. Any legal action that proceeds after mediation shall be brought in the appropriate state or federal court located in NC, and both parties consent to the jurisdiction of such courts.
These Terms and any disputes arising from or related to them are governed by the laws of the State of North Carolina, without regard to its conflict of law provisions. Any legal proceedings shall be conducted in North Carolina.
These Terms, together with any signed service contract between you and Custom Hickory Fence & Deck, constitute the entire agreement between the parties with respect to the subject matter herein and supersede all prior discussions, representations, or agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force.
